Privacy Policy

JP Colors, LLC, a New York limited liability company (and its successors and assigns, the “Company”) operates the website known as d90manual.com (and any affiliated site and their successor site(s), the “Site”).  This Privacy Policy describes Company’s use and sharing of personally identifiable information (“PI”, e.g., your full name, email address, mailing address, telephone number) that you voluntarily provide to Company when you register (also known as “Registration PI”).  The Site is restricted to adults over 18 years of age. Company does not knowingly collect or publish any information personally identifying any child under age 13. Children under age 13 should not access the Site and should not post any information personally identifying themselves anywhere on the Site.

From time to time Company may modify this Privacy Policy to reflect industry initiatives or changes in the law, our PI collection and use practices, the features of the Site, or technology, and such modifications shall be effective upon posting by Company on the Site. Your continued use of the Site after Company posts a revised Privacy Policy signifies your acceptance of the revised Privacy Policy. It is therefore important that you review this Privacy Policy regularly to ensure you are updated as to any changes. If Company materially changes its practices regarding collection or use of your PI, your PI will continue to be governed by the Policy under which it was collected unless you have been provided notice of, and have not objected to, the change.

We respect your privacy. This is why we have taken the time to disclose our information collection practices and our privacy policy.

Collecting information provides specific benefits to our website visitors. To place an order in the store, for instance, information is required by PayPal, which is unrelated to Company, to process your order and payment.  Company is not responsible for any information provided by you to third parties, including PayPal.

Company agrees not to share any PI you individually supply to the Site without your express permission.  However, in respect unlawful online activities of any visitor, we reserve the right to reveal your identity (or whatever information we know about you) in the event of a complaint or legal action arising from any message, submission, or action by you. All actions on the Site are identified by an IP address accessible by forum administrators.

We collect information for the following purpose(s): Completing or supporting an activity on the Site; Site and system administration; and tailoring the Site for its visitors

In respect to unlawful online activities of any visitor, we reserve the right to reveal your identity (or whatever information we know about you) in the event of a complaint or legal action arising from any message, submission, or action by you.

The Site reserves the right to perform statistical analyses of user behavior and characteristics in order to measure interest in and use of the various areas of the Site and to inform advertisers of such information as well as the number of users that have been exposed to or clicked on their advertising banners. The Site will provide only aggregated data number of page views calculated by pixel tags, from these analyses to third parties. Also, users should be aware that the Site may sometimes permit third parties to offer subscription and/or registration-based services through the Site. The Site is not responsible for any actions or policies of such third parties and users should check the applicable privacy policy of such party when providing personally identifiable information.

Commercial entities are hereby put on notice that “harvesting” of e-mail addresses through the use of web “spiders” or other similar activities for the use of unsolicited commercial e-mail (UCE or “spam”) is strictly forbidden. Violation of this policy will lead to referral to the appropriate authorities, including the commercial entity’s Internet service provider, and appropriate legal authorities, when applicable. The Site reserves the right to invoice such unauthorized advertisers at our current cost per impression advertising rate for appropriation of these addresses. Unsolicited commercial emails are strictly prohibited through any mailings, and may result in the immediate billing for unauthorized advertising at the rate of $100.00 per subscriber per mail list utilized.

Users should be aware that non-personal information and data (including IP addresses) may be automatically collected through the standard operation of the Site’s internet servers or through the use of “cookies.” “Cookies” are small text files a web site can use to recognize repeat users, facilitate the user’s ongoing access to and use of the site and allow a site to track usage behavior and compile aggregate data that will allow content improvements and targeted advertising. Cookies are not programs that come onto a user’s system and damage files. Generally, cookies work by assigning a unique number to the user that has no meaning outside the assigning site. Users should be aware that the Site cannot control the use of cookies or the resulting information by advertisers or third parties hosting data for the Site. If a user does not want information collected through the use of cookies, there is a simple procedure in most browsers that allows the user to deny or accept the cookie feature; however, users should note that cookies may be necessary to provide the user with certain features (e.g., customized delivery of information) available on the Site.  A pixel tag is a tiny image inserted in a webpage and used to record the number and types of views for that page. Company may allow third party pixel tags to be present on Site for purposes of advertising, providing services or data and statistics collection.  Anonymous click stream, number of page views calculated by pixel tags, and aggregated demographic information may also be shared with Company’s advertisers and business partners.  We use your IP address to help diagnose problems with our server and to administer our website. We also use your IP address to help identify you and your shopping cart.

You can program your computer to warn you each time a cookie is being sent, block third party cookies or block all cookies. However, by blocking all cookies you may not have access to certain features on the Site.

Upon request, the Site will allow any user to “opt out” of further promotional contacts at any time. Additionally upon request, the Site will use reasonable efforts to allow users to update/correct personal information previously submitted which the user states is erroneous to the extent such activities will not compromise privacy or security interests. Also, upon a user’s request, the Site will use commercially reasonable efforts to functionally delete the user and his or her personal information from its database; however, it may be impossible to delete a user’s entry without some residual information because of backups and records of deletions.

The Site reserves the right to change this policy at any time by notifying users of the existence of a new privacy statement. This statement and the policies outlined herein are not intended to and do not create any contractual or other legal rights in or on behalf of any party.

The Site may be linked to Internet sites operated by other companies. The Site may also carry advertisements from other companies. Company is not responsible for the privacy practices of websites or other services operated by third parties that are linked to or integrated with the Site or for the privacy practices of third party Internet advertising companies. Once you leave Site via such a link, access a third party application (such as widgets) or click on an advertisement, you should check the applicable privacy policy of the third party or advertiser site to determine, among other things, how they will handle any PI they collect from you.

Site may also be linked to sites operated by companies affiliated with Company. Users who visit those affiliated company sites should still refer to their separate privacy policies and practices, which may differ in some respects from this Privacy Policy.

By submitting your email address on the Site, you have consented to receive promotional materials (e.g., newsletters) or notifications from Company and Company may periodically use your email address to send you such materials related to the Site, as applicable. If you want to stop receiving such materials from Company, you can change your profile settings under “Account Settings,” or follow the unsubscribe instructions at the bottom of each email.

Company may transfer part or all of your information in the case of a merger, acquisition, bankruptcy, or other sale of all or a portion of the Company’s assets or stock.

When a Member who is located in the European Union chooses to post Profile Information that will be publicly disclosed, that Member is responsible for ensuring that such information conforms to all local data protection laws. Company is not responsible under the EU local data protection laws for Member-posted information.
